Roberts Jr. told an audience that he was “very troubled” by the “setting, circumstance and decorum” of the State of the Union speech where justices are forced to sit expressionless while Congress, “literally surrounds them” at times cheering and hollering.
Roberts was reacting to President Obama’s last State of the Union address where the President criticized Citizen’s United, the Supreme Court decision that invalidated decades-old federal legislation restricting corporate expenditures for electoral advocacy.
Six of the nine justices of the Supreme Court were sitting in the audience, and the cameras captured Justice Samuel Alito, shaking his head in disagreement when Obama said, “With all due deference to the separation of powers, last week the Supreme Court reversed a century of law that I believe will open the floodgates.”
Democratic senators sitting close to the justices stood up and cheered the president’s words.
The justices rarely applaud the event, fearful that it might send the message that they are taking sides on an issue which might come before them.
Several weeks later Roberts commented on the experience and said, “to the extent the State of the Union has degenerated into a political pep rally, I’m not sure why we are there.”
This year’s State of the Union might be a very different atmosphere because several members of Congress have stated their intention to sit next to a member of the opposing party in order to send a message of comity to the American public.
A press spokeswoman for the Court said that Justice Samuel Alito will miss this year’s speech due to a commitment in Hawaii but she had no information on the plans of the other justices. It will be Justice Elena Kagan’s first State of the Union.

Happy New Year 2011: OK. Just like last year*, let’s skip this one.
I mean come on, look back at 2010 and tell me what you see :
January – the health care reform passed, Obama reveals all his preexisting conditions, including allergy to Portuguese water dogs and FOX News
February – winter olympics : Michael Phelps wins all events not run by Usain Bolt but fails at the femininity tests
March – Benedict XVI proclaims Vlad III the Impaler a Saint for his resistance to the Ottoman Empire and his knowledge of Latin
April – Burj Dubai is completed under the name Burj Abu Dhabi
May – Ayatollah Khamenei dies but not before nominating his successor : “Iran needs a hardcore fundamentalist who can exceed his powers and fix a ballot, and no one seemed more qualified than Ayatollah George W. Bush”
June – One year later, a goose moonwalks over Michael Jackson’s grave. The grave itself has already moonwalked 10 yards in the direction of Beverly Hill’s preschool.

November – US midterm elections evenly splits the congress : 1/3 Democrats, 1/3 Republicans, 1/3 Palinian Theocrats
December – Glenn Beck in Oslo to accept his Nobel Peace Prize : “gee… it’s a bit premature… unless you give it to me so that I don’t have to implement my program”

BUFFALO, N.Y. – Hoods were up and heads were down as a storm that plagued the Midwest for days plodded into the Northeast on Tuesday with knifing winds and blowing snow, stranding dozens of motorists on a southern Ontario highway and giving much of the region its first real taste of winter. The storm, with its bone-chilling cold, continued its trek over the Great Lakes and into Canada.
